and Conditions
Rental:
Prior to 3:00pm, charges start on the day
equipment is picked up. After 3:00pm, rental
charges start the following day. Equipment
returned after 10:00am without prior arrangement
will be charged an additional day. Weekly
rates for presentation equipment is three
times the daily rate, production equipment
is four times the daily rate and monthly rates
are four times the appropriate weekly rate.
Minimum rental is one day and minimum billing
is $25 per rental. Cancellation of rentals
without 24 hours notice may be subject to
charge of 50% of the total rental in addition
to all charges incurred by APS on behalf of
the renter. All terms, conditions and prices
quoted or published by APS are subject to
change without notice.
Terms:
The rental begins on the date when the customer
picks up or equipment is shipped for the rental
order and concludes when the equipment is
physically received or picked up by APS or
a designate.
Item
Failure: The customer
agrees to immediately stop using equipment
should that equipment become damaged or unsafe
and immediately notify APS. The customer accepts
responsibility for any injury or damage including
consequential damage resulting from equipment
failure or defect.
Acceptance:
The customer may be asked to provide APS with
a written statement acknowledging receipt
of equipment in good condition. Irrespective
of a written statement, the customer acknowledges
receipt and acceptance of the equipment by
either paying for or using the equipment.
Physical
Condition:
The customer acknowledges that he or she is
aware of the equipment’s condition and
agrees to return the item(s) to APS in the
same condition as received to APS. Should
the equipment be returned to another APS office,
the customer agrees to pay shipping charges
to the equipment’s place of origination.
Use
of Item(s): By accepting
the equipment the customer is satisfied with
any instruction provided by APS or is familiar
with the equipment’s proper and safe
use. The customer also agrees to use the equipment
solely for the purpose it was manufactured
and intended. Subleasing or improper use of
equipment is prohibited.
Responsibility
for Equipment:
The customer accepts responsibility for the
rental equipment from the beginning of the
rental until the item is physically received
by an APS employee or designate. This may
include a cleaning charge.
Responsibility
for Use:
The customer assumes all responsibility for
the equipment from time of acceptance until
the equipment is received by APS or a designate.
The customer assumes all risks inherent in
the operation and use of the equipment and
agrees to assume the entire responsibility
for the defense of, payment of, indemnify
and hold harmless the Lessor from any and
all claims. Lessee agrees that no warranties,
expressed or implied have been made in connection
with this rental.
Payment:
The customer agrees to pay all rental charges
to APS or a designate on demand. The customer
represents that he or she has a right to charge
for rental equipment from APS on behalf of
others. If payment for charges is not received
within 10 days after due date, APS has the
right to recalculate charges on a daily rental
basis. Should collection be necessary, the
customer accepts responsibility for all collection
fees.
Modification:
No modification to these Terms & Conditions
may be made except in writing and as part
of the original Rental Contract.
Travel,
Delivery & Pickup:
Travel outside a metropolitan area or over
30 miles from the originating APS office is
billed at 35 cents per mile or at cost of
vehicle rental or airfare. Travel time is
charged at $40 per hour per employee plus
meal and lodging costs.
Insurance:
Insurance for the rented equipment is the
sole responsibility of the customer and the
customer assumes all responsibility for replacement
costs to APS in the event of damage or loss
of the equipment.
Labor:
APS Systems has a one hour minimum charge
at the labor rate starting at $40 per hour.
Straight time hours are 7:00am through 6:00pm
during non-holiday weekdays. Time and a half
is billed in 3 hour increments from 6:00pm
through 12:00 midnight during non-holiday
weekdays and from 7:00am through 12:00 midnight
Saturdays and Sundays. Double time will be
billed in 3 hour increments from 12:00 midnight
to 7:00am and holidays.
